Strategy or emotion – what’s driving defaults?

A recent Wall Street Journal article, Emotion Drives Many Defaults, reviews interesting new data on why people are defaulting on mortgages. For some, default is a rational response by homeowners who owe far more than the current value of their homes. For others, the reasoning is purely emotional, ranging from frustration and helplessness, to anger with banks and the government.

The article also notes that the “stigma against default remains robust” with the majority of people continuing to make payments for as long as they can, but I wonder how long this can continue. Loan modification programs are not providing much help or hope, and seem to be wearing down homeowners who really want to do the right thing.

The article suggests “a rent based loan program” to help homeowners who are in trouble. It’s an interesting and viable idea, but only a drop in the bucket. That said, every drop helps fill the bucket. I’m starting to see small improvements in the real estate market. In my neighborhood (Los Angeles), houses on the market are selling faster and the values seem to be increasing slightly. I am cautiously hopeful that this is the start of a more controlled recovery.

Scary times for real estate agents

Be afraid, be very afraid. Yesterday’s Los Angeles Times ran an article (5 charged with beating, robbing loan agents) that should put the fear into anyone working in real estate. No, it wasn’t about Halloween tricks, or problems with the economy, or a real estate market that’s still on the downside. It was about two loan modification agents (anyone working home loans or doing loan modification must have a real estate license) who were robbed and beaten by a couple who felt the agents had not done enough to save their home from foreclosure.

Now, I don’t know whether these “loan agents” were legitimate, or not. Regardless, I think the lesson to be learned here, is that we are living in volatile times, and whether you’re doing a good job, or you’re a slacker, you need to be careful. Emotions run high when people’s homes are at risk. If you have concerns about working with a client, talk about your concerns with a co-worker. Maybe it’s not the best idea to take the listing. Or maybe, until you’re concerns are resolved, you should meet with the client in your office, or take a co-worker with you when you go to their house. No job or commission is worth putting your life at risk. I know the situation described in the LA Times article was an anomaly, but maybe it’s good for us all to get this kind of “wake up call” from time to time. I want all of my students to be successful, but it’s even more important to be safe.

Cracking down on foreclosure scams

If you are concerned about a foreclosure and have been approached by an individual, or company offering to help you with a loan modification, beware! According to a recent article in the LA Times entitled State, US crack down on foreclosure scams, hundreds of thousands of people have been duped (click on the title of the article to read the details). If you need help with foreclosure or loan modification, be sure to do your homework before paying anyone for assistance

Similarly, if you’re working, or looking for work in lending, make sure the company you work for is ethical. Does the company require its agents to have real estate licenses? A recent article in the New York Times entitled Paper Avalanche Buries Plan to Stem Foreclosures details a frightening scenario for anyone needing a loan modification. The article describes in agonizing details, lost paperwork, inept processors, and a somewhat passive aggressive resistance from lenders when it comes to loan modification.

I don’t know why I was so surprised when I read the article; I found myself feeling shocked, horrified, and angry. Maybe I should have expected that the process would be a mess, maybe not. Maybe the article describes the exceptions, and most loan modifications are completed in a timely and cooperative manner. Or maybe I’m just crazy and overly optimistic. Crazy optimist that I am, I do expect the real estate market to rebound and be stronger than ever. Perhaps not tomorrow, or next week, but it will come back. It always does. Given that fact, “now” is a great time to get a real estate license. Maybe you want to invest while the market is down, get into the loan business, or be ready to sell as the market rises.
